Welcome to Hyke. These Terms govern your access to and use of our
website, any forms on this site (including interest sign‑ups), and any
related content (collectively, the “Services”). By accessing or using
the Services, you agree to these Terms. If you do not agree, do not use
the Services.
1) Who we are
Hyke helps people discover meaningful conversations in the real world.

2) Eligibility
You must be at least 16 years old to attend events through Hyke. To
purchase tickets or make payments, you must be at least 18 years old. To
create or organize events, you must be at least 20 years old.
If you are 16 or 17, you may attend events, but an adult (18+) must
purchase tickets on your behalf. Individual events may have higher age
requirements (e.g., 18+ or 21+ for alcohol events), which will be
clearly stated in the event description. You are responsible for
verifying you meet all event‑specific age requirements.
By using Hyke, you represent that you meet the applicable age
requirements for your intended use of the platform.
3) Acceptable use
You agree not to:
- break the law or infringe others' rights;
- harass, harm, or deceive others;

attempt to access systems, data, or accounts without authorization;
-
interfere with operation, integrity, or security of the Services;
- submit illegal, infringing, or abusive content.
4) Platform role & event services
Hyke is a marketplace platform, not an event organizer.
We provide technology that connects event organizers with attendees,
similar to how Airbnb connects hosts with guests or Eventbrite connects
organizers with ticket buyers.
What Hyke provides:
- A platform for organizers to create, publish, and manage events;

Tools for attendees to discover, book, and purchase tickets to events;
-
Payment processing infrastructure (through our third‑party payment
provider, Stripe);
-
Communication tools to facilitate interaction between organizers and
attendees;
- Customer support for platform‑related issues.
What Hyke does NOT do:

We do not organize, host, control, or endorse any events listed on the
platform;
-
We do not verify organizer licenses, permits, insurance, or
qualifications;
-
We do not inspect venues, assess safety measures, or guarantee event
quality;
-
We do not vet attendees or control who participates in events (except
as required by law);
-
We are not responsible for organizer conduct, event outcomes, safety,
cancellations, or disputes between organizers and attendees.
All events are created and managed by independent third‑party
organizers.
When you book an event, you are entering into a direct relationship with
the organizer, not with Hyke. The organizer is solely responsible for
delivering the event as described.
5) Organizer terms & responsibilities
If you create or organize events on Hyke, you agree to the following
additional terms:
Eligibility requirements
- You must be at least 20 years old;

You must have legal capacity to enter into binding contracts in your
jurisdiction;

You must comply with all applicable local, state/provincial, and
national laws.
Organizer representations & warranties
By organizing events on Hyke, you represent and warrant that:

Licenses & permits: You hold all necessary licenses,
permits, and authorizations required to host your event (including but
not limited to alcohol licenses, food safety permits, entertainment
licenses, and venue permits);
-
Insurance: For events with 20 or more attendees, you
maintain appropriate liability insurance with minimum coverage of CHF
2,000,000 (Switzerland) or AUD 5,000,000 (Australia), and will provide
proof upon request;

Accurate information: All event descriptions, photos,
pricing, dates, times, locations, and other information you provide
are truthful, accurate, and not misleading;
-
Venue rights: You have the legal right to use the
venue for your event and have obtained all necessary permissions from
property owners or managers;
-
Compliance: Your event complies with all applicable
laws, including safety regulations, accessibility requirements, and
anti‑discrimination laws.
Safety & conduct obligations
As an organizer, you must:

Provide a safe environment for attendees, including adequate security,
lighting, emergency exits, and first aid resources where appropriate;
-
Implement appropriate age verification procedures for age‑restricted
events;
-
Clearly communicate any physical requirements, health risks, or safety
considerations in your event description;
-
Respond promptly to attendee inquiries and platform communications;
-
Handle attendee data in compliance with applicable privacy laws
(including GDPR, Swiss Federal Act on Data Protection, and Australian
Privacy Act);
-
Refund attendees in accordance with your stated cancellation policy
and these Terms if you cancel or substantially modify an event.
Organizer indemnification
As an organizer, you agree to defend, indemnify, and hold harmless Hyke,
its affiliates, officers, employees, and agents from any and all claims,
liabilities, damages, losses, costs, and expenses (including reasonable
attorneys' fees) arising out of or related to:
- Your event(s), including injuries, property damage, or death;

Your failure to obtain necessary licenses, permits, insurance, or
authorizations;
- Breach of your representations, warranties, or obligations;
-
Your violation of any law or third‑party rights (including
intellectual property, privacy, or safety regulations);
- Disputes between you and attendees.
Account suspension & termination
We may suspend or terminate your organizer account immediately if you:
- Violate these Terms or applicable laws;
- Fail to maintain required licenses, permits, or insurance;
- Receive multiple complaints or negative safety reports;
- Engage in fraudulent, deceptive, or harmful conduct;
- Fail to deliver events as described or process refunds as required.
Upon termination, we may withhold any pending payouts pending resolution
of outstanding attendee claims or refunds.
6) Event attendance terms
If you attend events through Hyke, you agree to the following terms:
Attendee eligibility

You must meet the minimum age requirements specified in Section 2;

You must meet any additional age or eligibility requirements specified
by the event organizer;
-
You are responsible for ensuring you are physically and medically able
to participate safely in any event you book.
Acknowledgment of organizer responsibility
You acknowledge and agree that:

The event organizer, not Hyke, is responsible for the event.
This includes event quality, safety, venue suitability, staffing,
compliance with laws, and all other aspects of event delivery;

Hyke does not verify organizer credentials, licenses, or insurance,
and makes no representations about organizer reliability or event
quality;
-
Hyke is not liable for event cancellations, modifications,
no‑shows, poor quality, safety issues, injuries, or any other
event‑related problems;
-
Your sole recourse for event‑related issues is with the organizer, not
Hyke (though we provide dispute resolution support as described in
Section 7).
Assumption of risk
You acknowledge that participating in events involves inherent risks,
including but not limited to physical injury, illness, property damage,
or emotional distress. You voluntarily assume all risks associated with
event attendance. You are responsible for:

Reviewing event descriptions, requirements, and safety information
before booking;
- Assessing whether an event is suitable for you;
-
Following organizer instructions and venue rules during the event;
- Behaving respectfully and lawfully toward organizers and other attendees.
Age‑restricted events
For events involving alcohol or other age‑restricted activities, you
acknowledge that:

You may be required to show valid government‑issued photo ID at the
event;
-
If you fail to provide acceptable ID or do not meet the age
requirement, the organizer may deny you entry;
-
No refund will be issued if you are denied entry for failing to meet
age requirements or provide valid ID.
7) Payment terms
Event ticket purchases (attendees)
-
Event ticket prices are set by organizers. Hyke adds a platform service
fee (clearly disclosed at checkout) to cover payment processing and
platform costs;

All prices are displayed in the local currency (CHF for Switzerland,
AUD for Australia);
-
By completing a purchase, you authorize Hyke (via Stripe) to charge
your payment method for the full amount;
-
Payment is due immediately upon booking. Your ticket is confirmed once
payment is successfully processed;
-
We do not store your full payment card details. Payment processing is
handled securely by Stripe.
Organizer payouts
-
Ticket revenue (minus Hyke's platform fee and payment processing fees)
is held in escrow until the event is completed;
-
Payouts are processed 3–5 business days after the event end date,
provided there are no outstanding disputes or refund requests;
-
If attendees request refunds or dispute charges, we may delay or
withhold payouts until those issues are resolved;
-
You are responsible for providing accurate bank account or payment
details for receiving payouts.
Refund & cancellation policies
Organizer cancellations:
-
If an organizer cancels an event, attendees are entitled to a full
refund of the ticket price (platform fees may be deducted to cover
non‑recoverable payment processing costs);
-
Refunds for organizer cancellations are processed within 5–10 business
days.
Attendee cancellations:
-
Refund eligibility for attendee‑initiated cancellations is governed by
the organizer's cancellation policy (displayed on the event page);
-
If the organizer offers refunds, processing may take 5–10 business
days;
- Platform fees are generally non‑refundable for attendee cancellations.
Substantial event changes:
-
If an organizer makes substantial changes to an event (e.g., date,
time, location, or event type), attendees may request a full refund
within 48 hours of being notified of the change.
No‑shows:
-
If you purchase a ticket but do not attend the event, no refund will
be issued unless the organizer's cancellation policy explicitly allows
it.
Disputes:
-
If you believe you are entitled to a refund due to organizer
misconduct, event misrepresentation, or safety concerns, you must
contact
support@hykefresh.com
within 48 hours of the event;

We will review disputes on a case‑by‑case basis and mediate between
attendees and organizers, but we are not obligated to issue refunds
for organizer conduct.
Refund processing
Approved refunds are processed within 5–10 business days and will appear
on your original payment method. Refund timing may vary depending on
your financial institution.
8) Prohibited activities & events
Prohibited event types
Organizers may not create events that involve or promote:

Sale or service of alcohol without proper licenses or to minors;

Illegal activities (including drug use, gambling without permits,
unlicensed medical services, or activities prohibited by local law);
-
Dangerous or reckless activities without appropriate safety measures,
permits, or insurance;
-
Weapons, explosives, or hazardous materials (except where explicitly
authorized and licensed);
-
Discrimination based on race, ethnicity, religion, gender, sexual
orientation, disability, or other protected characteristics;
- Sexual services, adult entertainment, or sexually explicit content;
-
Pyramid schemes, multi‑level marketing recruitment events, or
deceptive financial schemes;
- Political fundraising or campaigning (unless properly disclosed and licensed);
- Events intended primarily to harass, intimidate, or harm others.
Prohibited conduct
All users (organizers and attendees) are prohibited from:

Creating fake or fraudulent events, profiles, reviews, or bookings;
-
Providing false, misleading, or deceptive information about events,
venues, pricing, or qualifications;
-
Price gouging, hidden fees, or last‑minute price increases not
disclosed at booking;
-
Harassment, threats, hate speech, or abusive behavior toward other
users, Hyke staff, or third parties;
-
Attempting to circumvent Hyke's payment system to avoid platform fees
(e.g., requesting direct payments outside the platform);
-
Spamming, unsolicited marketing, or using Hyke to collect user data
for purposes unrelated to events;
-
Violating intellectual property rights (e.g., using copyrighted images
or trademarks without permission);
-
Interfering with platform security, attempting to hack accounts, or
engaging in malicious technical activities.
Consequences
Violation of these prohibitions may result in:
- Immediate removal of event listings;
- Suspension or permanent ban of your account;

Withholding of payouts pending investigation or to cover refunds;
-
Referral to law enforcement or regulatory authorities where
appropriate;
- Legal action to recover damages or enforce these Terms.
9) Safety and real‑world interactions
Hyke connects people for real‑world events. While we strive to create a
safe platform, we cannot guarantee the safety of any event or
interaction. Your safety is your responsibility.
General safety disclaimer
Hyke does not control, verify, or assume responsibility for:
- The identity, background, or intentions of organizers or attendees;
- The safety, legality, or quality of events;
- The accuracy of event descriptions or organizer claims;
- Venues, equipment, or safety measures at events;
- Organizer compliance with laws, licenses, permits, or insurance requirements;
- Interactions between users before, during, or after events.
You participate in events entirely at your own risk. Hyke is not
liable for injuries, illnesses, property damage, financial losses, or
other harm resulting from event participation.
Your responsibility
Before attending any event, you should:

Research the organizer: Review their profile,
ratings, reviews, and past events;

Assess the event: Read the full description,
including location, activities, requirements, and safety information;

Verify legitimacy: If an event seems suspicious, too
good to be true, or unsafe, do not attend and report it to
safety@hykefresh.com;

Check the venue: Research the location online. Avoid
events at unknown or isolated locations if you feel uncomfortable;
-
Know local laws: Ensure the event complies with local
regulations (e.g., alcohol service, occupancy limits, noise
ordinances);
-
Assess your own safety: Consider your physical
health, mobility, allergies, and any personal safety concerns before
booking.
Safety recommendations
To protect yourself when attending events:
-
Meet in public: Choose events in well‑populated,
public venues, especially for first‑time organizers;
-
Tell someone: Inform a friend or family member where
you're going, when you expect to return, and share event details;
-
Stay sober & aware: Avoid excessive alcohol or
substance use that may impair your judgment;
-
Trust your instincts: If something feels unsafe or
uncomfortable, leave immediately;
-
Keep your phone charged: Ensure you can call for help
or transportation if needed;
-
Review emergency exits: Upon arrival, note exits and
emergency procedures;
-
Protect personal information: Do not share sensitive
personal details (home address, financial info, etc.) with organizers
or attendees unless necessary;
-
Report problems: If you witness unsafe conditions,
harassment, illegal activity, or Terms violations, report it
immediately.
Reporting & safety tools
If you experience or witness safety concerns, harassment, fraud, or
Terms violations:
-
For urgent safety issues or emergencies: Contact
local emergency services (police, ambulance) immediately. Do not wait
to contact Hyke in an emergency;

To report safety concerns to Hyke: Email

event details, user information, and a description of the issue;
-
In‑app reporting: Use the "Report" button on event
pages or user profiles to flag inappropriate content or behavior;
-
Block users: You can block organizers or attendees to
prevent further contact.
We review all safety reports and take appropriate action, which may
include warnings, account suspension, or permanent bans. We may also
cooperate with law enforcement investigations.
10) Your content
You retain ownership of content you submit (e.g., form inputs). You
grant us a limited, non‑exclusive, worldwide, royalty‑free license to
host, use, and process that content to operate and improve the Services.
Do not submit content you lack rights to share.
11) Intellectual property
The Services, including text, graphics, logos, and software, are owned
by or licensed to us and are protected by applicable laws. Except as
allowed by law or these Terms, you may not copy, modify, or create
derivative works based on the Services.
12) Third‑party services and links
The Services may link to third‑party sites (for example, Stripe for
donations). We do not control those sites and are not responsible for
their content, policies, or practices. Your use of third‑party services
may be subject to their terms.
13) Disclaimers
The Services are provided “as is” and “as available.” To the fullest
extent permitted by law, we disclaim all warranties, express or implied,
including implied warranties of merchantability, fitness for a
particular purpose, and non‑infringement. We do not warrant that the
Services will be uninterrupted, secure, or error‑free.
14) Limitation of liability
To the fullest extent permitted by law, we will not be liable for any
indirect, incidental, special, consequential, or punitive damages, or
any loss of profits or revenues, whether incurred directly or
indirectly, or any loss of data, use, goodwill, or other intangible
losses resulting from your use of or inability to use the Services.
15) Indemnification
You agree to defend, indemnify, and hold harmless Hyke and our
affiliates, officers, employees, and agents from any claims,
liabilities, damages, losses, and expenses (including reasonable
attorneys’ fees) arising out of or related to your use of the Services
or violation of these Terms.
16) Termination
We may suspend or terminate your access to the Services at any time if
we believe you have violated these Terms or to comply with law. You may
stop using the Services at any time. Sections intended to survive
(including IP, disclaimers, limitation of liability, and indemnity) will
remain in effect.
17) Governing law & jurisdiction
Jurisdiction‑specific terms
Your use of Hyke is governed by the laws of the location where events
take place:
For users and events in Switzerland:
- Governed by Swiss law;

Disputes subject to jurisdiction of courts in Canton Vaud,
Switzerland;
- Mandatory Swiss consumer protection laws apply.
For users and events in Australia:
- Governed by laws of Victoria, Australia;
-
Disputes subject to jurisdiction of courts in Victoria, Australia;
-
Australian Consumer Law protections apply and cannot be excluded.
General:

If you create or attend events in multiple locations, the applicable
law depends on each specific event's location;

Where permitted by law, you and Hyke agree to attempt good‑faith
negotiation before litigation;

Nothing in these Terms excludes statutory rights you have as a
consumer under mandatory local laws.
18) Changes
We may update these Terms from time to time. The “Last updated” date
shows when they were last revised. Material changes will apply
prospectively. Continued use of the Services after changes become
effective constitutes acceptance.
